The concept of Controlled Foreign Corporation has been brought in the bill that will address the concerns of companies parking their revenues overseas in a low tax jurisdiction in an increasingly globalised world. The bad news is that controlled foreign corporation (CFC) provisions are sought to be introduced, whereby passive income earned by a foreign company controlled from India would be deemed to be distributed to shareholders to prevent a tax deferral. While CFC legislation is prevalent in mature global economies, it is untimely to introduce CFC provisions in India at this stage, since Indian MNCs are still in their nascent stage and have had to face turbulence in the recent global recession.
